Privacy Policy

NovoLabs Limited (“NovoLabs”, “we”, “us”, “our”) is committed to protecting the privacy of personal information we collect, hold, use and disclose. This Privacy Policy explains how we handle personal information in accordance with the Privacy Act 2020 (New Zealand) and the Information Privacy Principles (IPPs).

This policy applies to our website at novolabs.co.nz (the “Website”), our products and services, and any interactions you have with us in connection with our business.

1. Who we are

NovoLabs Limited is a New Zealand-based manufacturer of ultraviolet disinfection systems, including the Supercritical UV™ technology. We are the “agency” responsible for the personal information described in this policy under the Privacy Act 2020.

2. Personal information we collect

We collect personal information that is reasonably necessary for our business activities. The types of personal information we may collect include:

  • Identity and contact details, such as your name, job title, company, email address, phone number and physical address.
  • Business and project information, such as details of your facility, application requirements, technical specifications and correspondence relating to enquiries, quotes, orders or support requests.
  • Account and transaction information, such as records of products or services purchased, invoices, payment details and delivery information (note: payment card details are processed by our payment providers and are not stored by us).
  • Employment-related information, where you apply for a role with us, such as your CV, cover letter, work history, qualifications, references and right-to-work information.
  • Website and technical information, such as your IP address, device and browser type, pages visited, referring URLs, and other analytics data collected through cookies and similar technologies (see section 8).
  • Marketing preferences, such as your subscription status for newsletters or updates and your responses to our communications.

Where it is lawful and practicable, you may interact with us anonymously or using a pseudonym (for example, when browsing general content on the Website). However, if we cannot identify you we may not be able to provide you with products, services or support.

3. How we collect personal information

We generally collect personal information directly from you, including when you:

  • Contact us through the Website, by email, phone or in person.
  • Request information, quotes or technical support, or engage us to supply products or services.
  • Subscribe to our communications, attend events, or interact with us on social media.
  • Apply for a job with us.
  • Use the Website (information is collected automatically through cookies and analytics tools).

In some cases we may collect personal information from third parties, such as your employer, our channel partners or distributors, publicly available sources, referees you have nominated, or service providers (for example, analytics and marketing platforms). We will only do so where it is permitted under the Privacy Act 2020.

4. How we use personal information

We collect, hold and use personal information for purposes connected with our business, including to:

  • Respond to your enquiries and provide quotes, information and technical support.
  • Supply, install, service and support our products, including the Supercritical UV™ system.
  • Manage our customer, supplier and partner relationships, including billing and account administration.
  • Conduct research, development and continuous improvement of our products and services.
  • Send you marketing communications, case studies and product updates where you have opted in or where permitted by law (you can unsubscribe at any time).
  • Operate, maintain, secure and improve the Website and our systems.
  • Assess job applications and manage recruitment.
  • Meet our legal, regulatory, accounting, tax and reporting obligations.
  • Detect, prevent and respond to fraud, security incidents and other unlawful activity.

We will only use personal information for a purpose other than the one for which it was collected if you have authorised us to do so, or if another exception under the Privacy Act 2020 applies (for example, where the use is directly related to the original purpose or is required or authorised by law).

5. Sharing and disclosing personal information

We do not sell your personal information. We may share personal information with the following categories of recipients, where it is necessary for the purposes described in this policy:

  • Our staff, contractors and group entities, on a need-to-know basis.
  • Service providers who support our business, such as IT and cloud hosting providers, customer relationship management platforms, payment processors, accounting and professional advisers, marketing and analytics providers, shipping and logistics partners, and recruitment providers.
  • Channel partners, distributors, installers and engineering consultants involved in delivering or supporting our products and services.
  • Government agencies, regulators, courts or law enforcement, where required or authorised by law.
  • A purchaser or prospective purchaser of our business or assets, subject to appropriate confidentiality protections.

We require our service providers to handle personal information consistently with the Privacy Act 2020 and only for the purposes for which we have provided it.

6. Sending personal information overseas

Because NovoLabs™ operates globally and uses cloud-based service providers, personal information may be stored or processed outside New Zealand, including in countries such as Australia, the European Union, the United Kingdom and the United States.

Where we disclose personal information to an overseas recipient, we will comply with Information Privacy Principle 12 of the Privacy Act 2020. This means we will only do so where one of the bases set out in the Act applies, such as where the recipient is in a country with comparable privacy safeguards, is required to protect the information on terms comparable to the Privacy Act 2020, or where you have authorised the disclosure after being informed that the overseas recipient may not be required to protect the information in a way that provides comparable safeguards.

7. Storing and protecting personal information

We take reasonable steps to protect personal information from loss, unauthorised access, use, modification, disclosure or other misuse. These steps include access controls, network security, encryption in transit, secure cloud hosting, staff training and confidentiality obligations.

No method of transmission over the internet or electronic storage is completely secure. While we strive to protect personal information, we cannot guarantee its absolute security.

We retain personal information only for as long as is necessary for the purposes for which it was collected, or as required by law (for example, tax and financial records). When personal information is no longer needed, we will take reasonable steps to securely destroy or de-identify it.

8. Cookies, analytics and tracking technologies

Our Website uses cookies and similar technologies to operate the site, remember your preferences, analyse usage and improve our services. Cookies are small text files placed on your device when you visit a website.

We may use first-party and third-party cookies, including analytics tools (such as Google Analytics) and marketing or social media pixels. These tools may collect information such as your IP address, browser, device, pages viewed and referring URL.

9. Direct marketing

We may send you marketing communications about our products, services, case studies and events where you have opted in or where permitted by law. Every electronic marketing message we send will include an option to unsubscribe. You can also opt out at any time by emailing info@novolabs.co.nz.

We comply with the Unsolicited Electronic Messages Act 2007 in relation to our commercial electronic messages.

10. Your rights

Under the Privacy Act 2020, you have the right to:

  • Request access to the personal information we hold about you.
  • Request correction of personal information that you consider to be inaccurate, incomplete, irrelevant, misleading or out of date.
  • Withdraw any consent you have given us (for example, to receive marketing communications), without affecting the lawfulness of processing before withdrawal.
  • Complain to us if you believe we have not handled your personal information in accordance with the Privacy Act 2020.

To make a request, please contact us using the details in section 12. We may need to verify your identity before responding. We will respond within the timeframes required by the Privacy Act 2020 (generally within 20 working days).

We may charge a reasonable fee for providing access to personal information in limited circumstances permitted by the Privacy Act 2020, and will tell you about any fee in advance.

11. Privacy breaches

If we become aware of a privacy breach that has caused, or is likely to cause, serious harm to affected individuals, we will notify the Office of the Privacy Commissioner and affected individuals as required by the Privacy Act 2020.

13. Job applications and recruitment

If you apply for a role with us, whether through the application form on our Careers page or by emailing careers@novolabs.co.nz, we collect the information you give us. That includes your name, contact details, the role you are applying for, your answers to our application questions, and any CV or other documents you send us.

We use this information only to assess your application, to contact you about it, and to keep a record of our hiring decisions. Applications submitted through our website are stored by our website provider on our behalf, and are accessible to the people at NovoLabs™ involved in hiring. We do not use recruitment information for marketing and we do not share it outside NovoLabs™ unless you ask us to or the law requires it.

We keep application information for up to two years so we can consider you for future roles, then delete it. If you would rather we deleted your application sooner, or you want to see or correct what we hold about you, email careers@novolabs.co.nz and we will action it. Your rights under section 10 apply to recruitment information in the same way as any other personal information we hold.

14. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements or for other operational reasons. The current version will always be available on our Website, with the “Last updated” date shown at the top. We encourage you to review this page periodically.
